Stiftelsen mod terrorisme (Fundación contra el Terrorismo), FCT, er involveret i en politisk motiveret forfølgelseskampagne under ledelse af Guatemalas offentlige anklagemyndighed mod journalister, anklagere og dommere, som har været involveret i at afsløre korruption og straffrihed i Guatemala, samt mod Guatemalas demokratisk valgte regering, herunder præsident Bernardo Arévalo. FCT har indledt en lang række strafferetlige efterforskninger mod retlige aktører, journalister og regeringsrepræsentanter ved at indgive strafferetlige anmeldelser og optræde som tredjepartssagsøger i straffesager, som tilsidesætter de tiltaltes grundlæggende rettigheder. Gennem disse handlinger deltager FCT i handlinger, der underminerer retsstatsprincippet i Guatemala, herunder forfølgelse og intimidering af medierepræsentanter samt advokater, dommere og anklagere.

- All assets of the listed persons and entities should be frozen. It is also prohibited to make any funds or assets directly or indirectly available to them. - Member States shall enforce travel restrictions on persons listed in the Annex of Council Decision (CFSP) 2024/254.

Official Information

In view of the persistent attempts to nullify the democratic results of the general and presidential elections in Guatemala, which resulted in a clear victory of President-elect Bernardo Arévalo, as attested by the EU Election Observation Mission (EOM) to Guatemala, the Council adopted an autonomous framework for restrictive measures in view of the situation in Guatemala on 12 January 2024. The restrictive measures consist of an asset freeze and prohibition to make funds available for individuals and entities, as well as a travel ban for individuals. The measures target those responsible for actions that undermine democracy, the rule of law and a peaceful transfer of power in Guatemala, including through persecution or intimidation of public officials, democratically-elected authorities, civil society, media and judicial operators among others, as well as through financial misconduct concerning public funds and the unauthorised export of capital. Derogations and exemptions to the restrictive measures are possible, including for the delivery of humanitarian aid.
