Jimi Bremer Ramírez is the First Instance Criminal Judge of the Tenth Court in Guatemala. In this capacity, he has issued arrest warrants and authorised investigations based on fabricated charges, and suspended hearings in those cases thereby limiting the right to a public hearing, access to justice and the right to a fair trial of the defendants. In February 2023, as supervising judge, Jimi Bremer Ramírez authorised the request of the Special Prosecutor's Office Against Impunity (FECI), which operates under the Public Ministry (Ministerio Público) of Guatemala (equivalent to the Public Prosecutor's Office) to investigate several journalists from the newspapers El Periódico and Prensa Comunitaria, following their coverage of high-level corruption in Guatemala. He suspended and deferred the court hearings of the founder of El Periódico José Rubén Zamora at least six times in one of the criminal cases against him. Furthermore, Jimi Bremer Ramírez delayed the procedures in the criminal cases against former prosecutors Stuardo Campo and Eduardo Pantaleón, and against the lawyer for the defunct International Commission Against Impunity in Guatemala (CICIG), Claudia González Orellana. Through those actions, Jimi Bremer Ramírez has engaged in and supported actions undermining democracy and the rule of law in Guatemala, including persecution and intimidation of the representatives of the media, and of lawyers and prosecutors in Guatemala.

- All assets of the listed persons and entities should be frozen. It is also prohibited to make any funds or assets directly or indirectly available to them. - Member States shall enforce travel restrictions on persons listed in the Annex of Council Decision (CFSP) 2024/254.

Official Information

In view of the persistent attempts to nullify the democratic results of the general and presidential elections in Guatemala, which resulted in a clear victory of President-elect Bernardo Arévalo, as attested by the EU Election Observation Mission (EOM) to Guatemala, the Council adopted an autonomous framework for restrictive measures in view of the situation in Guatemala on 12 January 2024. The restrictive measures consist of an asset freeze and prohibition to make funds available for individuals and entities, as well as a travel ban for individuals. The measures target those responsible for actions that undermine democracy, the rule of law and a peaceful transfer of power in Guatemala, including through persecution or intimidation of public officials, democratically-elected authorities, civil society, media and judicial operators among others, as well as through financial misconduct concerning public funds and the unauthorised export of capital. Derogations and exemptions to the restrictive measures are possible, including for the delivery of humanitarian aid.
